12/16/2015: Overtime Eligible PCA Employment & Wage Agreement Addendum [ View Forms ]
This optional addendum is only for PCA employees who are requesting to be classified as an Overtime (OT) Eligible PCA. You may sign this agreement and email/fax to our office. Please read and consider all terms listed this agreement before signing. Approval is not guaranteed and may take up to 14 days to be reviewed. PCAs are not allowed to work over 40 hours per week without a copy of this agreement signed by all parties.

12/08/2015: PCA Servive Verification Phone Calls - Reminder: ACP is required by law (effective 8/1/2015) to conduct unscheduled telephone calls with the consumer and the PCA to verify that the PCA is present and providing services. These calls will be made to the consumer and/or PCA’s phone and must be conducted at least every 90 days. If the consumer has more than one PCA, we will contact a different PCA at least every 90 days (possibly sooner) until we have verified with all of the PCA staff. You may elect to have unscheduled in-home verification visits with our QP, please contact us to request verification visits instead of phone calls. Consumers & PCAs must answer verification calls, repeated failed calls will result in an email notice of non-compliance and may result in mandatory monthly supervision visits, suspension or termination of services.

10/27/2015: 2015 PCA Overtime Policy Change Notice
As you may recall we had issued a notice last year regarding a PCA overtime policy change that was implemented and later reversed through the legal system. Recently the Fair Labor Standards Act (FLSA) rule changes were upheld in appeals court and the subsequent appeal to the U.S. Supreme Court was denied. So we are writing once again to officially notify our Clients and PCAs of the upcoming Fair Labor Standards Act (FLSA) rule changes regarding PCA overtime. For decades the Minnesota Labor Laws required overtime pay for PCAs who work more than 48 hours per week. The Federal law has always been 40 hours but exemptions allowed state law to override the federal rules. Effective the week of Nov. 12, 2015 the U.S. Department of Labor will enact the “Fair Labor Standards Act (FLSA) Final Rule” which will require overtime pay for employees who work more than 40 hours in a 7-day period. 01/19/2015: 2015 PCA Overtime Policy Reversal Notice
We are writing to officially notify our Clients and PCAs that the 2015 Fair Labor Standards Act (FLSA) rule changes regarding PCA overtime have been over-ruled by the courts and therefore our policy change that went into effect on 1/1/2015 has been retracted as of 1/19/2015.

The judge has directed the Department of Labor take up the issue with congress to have the law changed. The Department of Labor has stated that they disagree with the order and considering their legal options.

This ruling may change at any time, but until the policy re-instated by the courts or a law is passed in congress, we will be reversing our policy back to the old policy prior to 1/1/2015. We do not foresee any action on this issue until at least July, but we have no legal timeline or control over this.

What this means for Clients
If you currently have PCAs who work over 40 hours per week, you will be able to schedule your PCAs for up to 48 hours per week.

What this means for PCAs

All PCAs will be permitted to work up to 48 hours per week (or previously authorized OT amounts).

We are writing to officially notify our Clients and PCAs of the upcoming Fair Labor Standards Act (FLSA) rule changes regarding PCA overtime. For decades the Minnesota Labor Laws required overtime pay for PCAs who work more than 48 hours per week. The Federal law has always been 40 hours but exemptions allowed state law to override the federal rules. Effective Jan. 1, 2015 the U.S. Department of Labor will enact the “Fair Labor Standards Act (FLSA) Final Rule” which will require overtime pay for employees who work more than 40 hours in a 7-day period.

This new ruling will directly affect our company overtime policy and will affect many of our Clients and PCAs. We will be restricting all PCAs to work no more than 40 hours per 7-day period (Sun.-Sat.). We are unable to pay any overtime from this point forward. Unfortunately the Medicaid re-imbursement rates do not issue additional compensation to agencies to pay overtime wages for the dedicated PCAs who work more than 40 hours a week.
